Question: What is the so-called Zero Tolerance law in Wisconsin?

Answer: The Zero Tolerance Law is that if a person is driving a vehicle [and] they’re under the age of 21, they can have zero alcohol in their system. Because they’re not legal to drink any alcohol, there’s a special law that says they cannot drive with any alcohol in their system. Instead of a .08 requirement, they have a .00 requirement. That being said, it is a slightly different charge if someone under the age of 21 is driving and they are under a .08 but over the .00. They’re not going to get a standard OWI with full-blown OWI regulations. It’s an absolute sobriety violation. It is serious; it has serious consequences. But it is a slightly different charge then the standard OWI offense would be.
