Answer: The administrative review hearing form request is given to the Department of Transportation to essentially give that department notice that the person arrested for OWI did not agree that the suspension should happen. By sending this form in, the DOT—or Department of Transportation—will then schedule a hearing where certain issues can be argued by a lawyer. Our firm always subpoenas the officers involved to find out the good and bad aspects of the case. This is eminently important of the defense, as oftentimes the entire defense can be set up through cross-examination of the officers at this hearing. It’s a very nice hearing for the defense, because the prosecution doesn’t even become involved until it goes to court.
