If a person operates or handles that weapon in a way that causes bodily harm to a person, and that there was a risk of either death or great bodily harm and that risk was unreasonable and substantial, the person should have been aware that his or her conduct created that risk, then they’re guilty of injury by negligent handling of a dangerous weapon. We have even seen this charged in non-firearms cases where there is another weapon that is used. I’ve seen it charged where someone drove a vehicle in a way that created a substantial risk and they were charged with this crime.
