Answer: Collateral attacks can be brought to challenge prior criminal offenses in both the OWI and drug context where the person didn’t have an attorney and did not properly waive the right to an attorney in the previous case. I wrote the original article teaching attorneys how to handle these in Wisconsin about 20 years ago. It’s still an effective mechanism for attorneys who understand this area of law to help their clients avoid many of the severe repercussions of these types of cases.
